TERMS & CONDITIONS (Seller)
The purpose of this agreement is to set forth the standard terms and conditions under which Classic Abode Ltd. will provide garden services or maintenance for any given customer and, apply unless otherwise agreed.
Our estimate represents our best guess of the final price, having regard to the materials chosen, extra material, services, equipment and, hours of work to complete. We aim to meet our estimate but if an increase is necessary then it would have regard to the foregoing.
Any addition and/or alterations to the original schedule and scope of works, verbal or otherwise, shall be properly treated as variations resulting in alteration of the final price chargeable.
Our price assumes we remove from site all & any surplus materials.
EXECUTION OF WORKS
The client shall provide access to unlimited water and electricity at no charge to Classic Abode Ltd.
The client shall provide unfettered access to site during normal working hours (08:00 – 18:00) and allow storage space for materials and equipment during progress of the works.
Classic Abode Ltd. is not able to accept responsibility for any damage to (or cost resulting from) any underground hazards, obstructions or services not made known to us verbally or in writing, or apparent on visual inspection.
All or any special conditions, of which Classic Abode Ltd. has been informed, are noted in the estimate.
It is very important and the responsibility of the client to ensure we are made aware of any special / statutory bylaws / conditions / permissions that may be involved.
We accept no responsibility for works that have been carried out on land that is not under the ownership of the client where third party consent has not been received and, it is assumed that all planning laws or regulations have been applied before commencement of any works.
If necessary we reserve the right to substitute any plant with another of equal value and growth/habitat/colour in accordance with the specification.
We are not able to accept responsibility for the well being and maintenance of living plant material, including turf, following practical substantial completion unless a maintenance contract is in existence.
After practical substantial completion, we are not able to accept responsibility for any damage through the elements, including drought, winds, rain and frost to any material(s) including plants.
Upon practical substantial completion the responsibility for the care and watering of all plants, lawns, etc., is handed over to the client and will require regular attention until established.
Severe weather conditions, including drought, may cause the delay of the start date or completion date of the contract and schedule of works.
Classic Abode Ltd. reserves the right to vary the start date, completion date and complete schedule of works of any given project as necessary for any reason.
Delays caused by other companies on site may cause work to be rescheduled and charges may be made in certain circumstances.
Maintenance is not included in the contract unless specified.
The client will be responsible for all payments to Classic Abode Ltd. unless otherwise notified in writing prior to commencement.
Mobilization payments as detailed in the estimate are payable with order.
Stage payments are required as detailed in the estimate with a final payment to be made following completion in line with the terms detailed on our invoice.
All materials on site remain the property of Classic Abode Ltd. until payment is received in full.
We reserve the right to change these terms and conditions at any time.
